Hi

My name is Mbeki and need some clarity here. Margistrates courts are lower courts on hierachy of court and have jurisdiction on all criminal matters except treason, murder, rape, and compelled rape, and may impose punishments of up to three years in prison and a fine of up to ZAR 60,000.

Recently, Stellenboch margistrate court find the killers of Stellenboch student killers (Hannah Cornellius guilty of murder, rape and attempted murder her friend.

Now my question is what makes this lower court to impose such sentence as it is not allowed by the hierachy of South African courts?
